Measures for Compensation for Expropriation of Buildings Involved in Construction of 220kV and 110kV Overhead Power Transmission Lines in Nansha District (Revision)

Chapter I General Provisions

Article 1       For the purposes of safeguarding the power supply and accelerating the construction of the power grid in Nansha district, these measures are formulated in light of the reality of the implementation of electric power projects in Nansha district, in accordance with such laws, regulations, and normative documents as the Regulations on Compensation for Expropriation of Buildings on State-Owned Land, the Regulations on Protection of Power Facilities, the Detailed Rules for Implementation of the Regulations on Protection of Power Facilities, the Provisions of Guangzhou Municipality on the Administration of Supply and Utilisation of Electricity, the Opinions on Compensation in Construction of 110kV or Above Overhead Transmission Lines, the Guiding Opinions on Compensation for Expropriation of Residential and Commercial Buildings on State-Owned Assigned Land in Nansha District of Guangzhou Municipality (Normative Document No. 2 [2019] of the General Office of Nansha District People's Government of Guangzhou Municipality), the Measures for Compensation and Resettlement for Expropriation of Collectively-Owned Land and Buildings on Collectively-Owned Land in Nansha District of Guangzhou Municipality (No. 2 [2018] of the General Office of Administrative Committee of Guangzhou Nansha Development Zone).

Article 2       These Measures apply to the expropriation of buildings involved in the projects of 220kV and 110kV overhead transmission lines (buildings within the range of eighteen [18] meters extending from the centre line of 220kV lines on both sides, and buildings within the range of twelve [12] meters extending from the centre line of 110kV lines on both sides) in the administrative area of Nansha district.

Article 3       The building expropriation department of Nansha district is responsible for organizing the implementation of building expropriation, compensation, and resettlement in accordance with these Measures.

Governments of towns (or offices of street communities), entrusted by the building expropriation department of Nansha district, are responsible for the specific implementation of these Measures.

Chapter II Compensation for Building Expropriation

Article 4       Where the rights holder of the building involved agrees to the expropriation after consultation between the building expropriation department of Nansha district and the rights holder, the expropriation, compensation, and resettlement shall be implemented in accordance with the Guiding Opinions on Compensation for Expropriation of Residential and Commercial Buildings on State-Owned Assigned Land in Nansha District of Guangzhou Municipality (Normative Document No. 2 [2019] of the General Office of Nansha District People's Government of Guangzhou Municipality), and the Measures for Compensation and Resettlement for Expropriation of Collectively-Owned Land and Buildings on Collectively-Owned Land in Nansha District of Guangzhou Municipality (No. 2 [2018] of the General Office of Administrative Committee of Guangzhou Nansha Development Zone).

Article 5       Due to the difficulties in implementing demolition and resettlement, upon consent of the Nansha district people's government, the building expropriation department of Nansha district may consult with the rights holder of the building involved, provided that the national regulations on safety clearance and environmental protection are met. Where the rights holder agrees to the power lines passing the house, the building expropriation department of Nansha district, entrusted by the power supply department, will offer a compensation of thirty percent (30%) of the building appraisal value in accordance with relevant regulations. Such compensation payment shall be borne by the power supply department, and shall be listed in the project advance payment.

Article 6       Provided that the national regulations on safety clearance and environmental protection are met, if the rights holder does not agree with the compensation offered by the building expropriation department of Nansha district and demands exceedingly large compensation, the building expropriation office of towns or street communities will send a notice to the rights holder. If the rights holder neither agrees nor replies to the notice within three (3) months, the power lines will pass the building. If the rights holder still does not agree with the passing of the power lines six (6) months after the implementation of the project, the building expropriation department of Nansha district may make a notarized deposit of the compensation payment and inform the rights holder.

Article 7       The building passed by the power lines shall be maintained as it is when the lines are constructed, and reconstruction or expansion shall not be allowed. Buildings that have been identified to be dilapidated shall be dealt with in accordance with relevant regulations.

Chapter III      Supplementary Provisions

Article 8       These Measures shall come into force on the date of promulgation and shall remain in force for five (5) years. Problems encountered in the implementation shall be directly reported to the Nansha District Bureau of Housing and Urban-Rural Development.
